In recent years, there has been a growing interest in tourist apartments, exponentially increasing both the supply and demand for this type of rental.
Tourist apartments in Spain are not regulated by a State Law, but rather each Autonomous Community has the authority to develop the regulations that regulate these rentals. This is why the requirements for obtaining a license that allows you to rent your home for tourist use will vary depending on where the property is located.
In general but not limited terms, the requirements for obtaining this type of license are usually: application to the Town Hall for a certificate of urban compatibility; Valid Certificate of Habitability and Energy Certificate; Payment of fees; and Registration in the corresponding Registry.
Owners who are tax residents in Spain will allocate these incomes to the General Tax Base, having to bear a tax burden of between 19% and 47%.
However, owners who are not tax residents in Spain and have this type of rental will bear a tax rate of 19% (if they belong to the European Union) or 24% (if they do not belong to the European Union). The latter cannot deduct the expenses generated during the rental.
