Non-lucrative visa

The non-lucrative visa authorization is a type of visa that is granted to non-European citizens who want to reside in Spain without working. This visa is usually requested by people looking to retire in Spain, as it allows both the applicant and their family to stay in Spain for 1 year. Subsequently, the residence permit can be renewed successively every 2 years. Once the applicant completes 5 years of residence in Spain, they will be able to opt for the long-term residence authorization, which will allow them to reside (and work if they wish) in Spain for a period of 5 years, extendable. 

¿What requirements must I meet?

Los requisitos pueden variar de un momento a otro, por eso es altamente recomendable que cuentes con el asesoramiento de un especialista. A continuación, se van a indicar los requisitos exigibles en 2024:

    • Not being a citizen of a State of the European Union, the European Economic Area or Switzerland.
    • Not being irregularly in Spanish territory.
    • To not have criminal record in Spain or in the countries where you have resided during the last five years.
    • Not being prohibited from entering Spain and not appearing as rejected in the territorial space of countries with which Spain has signed an agreement in this regard.
    • To have sufficient financial means to cover the expenses during your stay in Spain and, where applicable, those of family members accompanying the applicant, in accordance with the following amounts:
    • o For the applicant: 400% of the IPREM, this is in 2024, 28,800.00 Euros
    • o For each of your family members, 100% of the IPREM, this is in 2024, 7,200.00 Euros
    • Take out health insurance with an Insurance Entity authorized to operate in Spain.
    • Not to suffer from any of the diseases that may have serious public health repercussions in accordance with the provisions of the International Health Regulations of 2005.
    • Not being, if applicable, within the period of commitment of non-return to Spain that the foreigner has assumed when accepting a voluntary return program.
    • Payment of the corresponding fee.

¿How to apply for a Non Lucrative Visa?

    1. Request an appointment at the Spanish consulate of the country of residence and assist such appointment with all the necessary documents.
    2. The response process may take up to three months, depending on the Consulate.
    3. Once the non-lucrative residence visa is approved and granted, the applicant must collect it within a period of one month. From that moment, you have three months to enter Spain.
    4. Once in Spain, you must apply for the Identity Card for Foreigners (TIE) within one month.

Residence by Investment (Golden Visa)

Non-resident foreigners who intend to enter Spanish territory to make a “significant investment” of capital may apply for a residence visa for investors.

REQUIREMENTS

    • To not have criminal record in Spain or in the countries where you have resided during the last five years.
    • To have sufficient financial means to cover the expenses during your stay in Spain and, where applicable, those of family members accompanying the applicant, in accordance with the following amounts:
    • o For the applicant: 400% of the IPREM, this is in 2024, 28,800.00 Euros
    • o For each of your family members, 100% of the IPREM, this is in 2024, 7,200.00 Euros
    • Take out health insurance with an Insurance Entity authorized to operate in Spain.
    • To make a significant investment in Spain:
      • 500,000.00 Euros in the acquisition of real estate. (Although the Government, on May 8, 2024, announced its intention to abolish this type of investment for the acquisition of this residence permit, it has not yet been made firm. Therefore, and until otherwise published in the Official State Gazette (BOE), foreigners who have made this investment can obtain this permit.)
      • Or, 1,000,000.00 Euros in shares or participations in Spanish companies, or, where applicable, in bank deposits in Spanish financial institutions.
      • Or, 2,000,000.00 Euros in the acquisition of Spanish Treasury Bonds.

Spanish Nationality

Spanish nationality by option
There are a series of cases in which a person can opt for Spanish nationality, that is, they have the right to decide whether they want to acquire Spanish nationality or not:

    • People who are or have been subject to the parental authority of a Spaniard. (Frequently applied: minor children of foreigners who become Spanish nationals.
    • Those whose father or mother had originally been Spanish and born in Spain, in this case there is no age limit to make the option (children of immigrants who were not born Spanish).
    • A foreigner over eighteen years of age adopted by a Spaniard may opt for Spanish nationality of origin within a period of two years from the constitution of the adoption.
    • Parentage or birth in Spain, the determination of which occurs after the age of eighteen, is not in itself a cause for the acquisition of Spanish nationality. The interested party then has the right to opt for Spanish nationality of origin within a period of two years from that determination.

Spanish Nationality by continued residence in Spain

Spanish nationality is also acquired by residence in Spain, through the concession granted by the Minister of Justice, who may deny it for reasoned motives of public order or national interest (having a criminal record or not speaking Spanish, amongst others).

¿Who can apply?

    1. The interested party who is emancipated or over eighteen years of age.
    2. Anyone over fourteen years of age assisted by their legal representative.
    3. The legal representative of the minor under fourteen years of age.
    4. The legal representative of the incapacitated person or the incapacitated person, alone or duly assisted, as resulting from the incapacity ruling.

The legal representative may only make the request if he or she has previously obtained authorization from the person in charge of the Civil Registry of the declarant's domicile, following an opinion from the Public Prosecutor's Office. Said authorization will be granted in the interest of the minor or incapacitated person.

¿When can you request Spanish Nationality by continued residence?

To be granted nationality by residence, it is generally required that you have resided in Spain for ten years. Five years will be sufficient for those who have obtained refugee status. Two years in the case of nationals of origin from Ibero-American countries, Andorra, the Philippines, Equatorial Guinea or Portugal or Sephardim.

A residence time of one year will be enough for:

    1. Anyone who was born in Spanish territory.
    2. Anyone who has not timely exercised the right to opt.
    3. Anyone who has been legally subject to the guardianship, custody or shelter of a Spanish citizen or institution for two consecutive years, even if they continue in this situation at the time of the application.
    4. Anyone who, at the time of the application, has been married to a Spaniard for one year and is not legally or de facto separated.
    5. The widow or widower of a Spanish person, if upon the death of the spouse there was no legal or de facto separation.
    6. Those born outside of Spain to a father or mother, grandfather or grandmother, (not born in Spain) who had originally been Spanish.
